NyxPixie is an email triage and end-of-day digest service operated by CNG Studios LLC, a Florida limited liability company (“Company,” “we,” “our,” or “us”), accessible at nyxpixie.com and app.nyxpixie.com (the “Service”). NyxPixie is part of the My Pixie Suite family of products operated by CNG Studios LLC.

Umbrella relationship. These NyxPixie Terms are a product-specific supplement to CNG Studios LLC’s overall My Pixie Suite Terms of Service, Privacy Policy, Acceptable Use Policy, Data Processing Agreement, Refund Policy, and DMCA Policy.

These Terms add NyxPixie-specific provisions (Google API usage, AI-classification disclaimers, beta period). Where this NyxPixie document is silent, the parent My Pixie Suite Terms of Service apply. Where a conflict arises, this product-specific document controls solely with respect to NyxPixie.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Plain-English summary: NyxPixie reads your Gmail and Calendar (read-only) to send you a daily digest. You can cancel any time. We don’t guarantee perfection — an AI might miscategorize an email — so don’t use NyxPixie as your only safety net for life-critical messages. We’re a small team and we’ll do our best.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that (a) you have the legal capacity to enter into these Terms, (b) you will provide accurate and complete information during account setup, and (c) your use of the Service will comply with all applicable laws.

2. Account and Authentication

Accounts are provisioned by invitation during the beta and Founders periods. You are responsible for maintaining the confidentiality of your magic-link tokens, browser session, and any credentials used to access the Service. You agree to notify us immediately of any unauthorized access by emailing support@mypixiesuite.com.

3. The Service

NyxPixie connects to your Google account (Gmail and Calendar) via OAuth, classifies your inbox using AI models running on our private infrastructure, and delivers a daily digest summarizing what mattered. The Service may also (with your authorization) deliver alerts via Telegram or email, surface broken-unsubscribe senders, and provide a dashboard for reviewing classified mail.

The Service does not send email on your behalf, modify your Gmail messages, or write to your Calendar. We use Google’s read-only scopes only.

3.1 Use of Google User Data

NyxPixie’s use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. See our Privacy Policy for full details.

3.2 AI classification — not a substitute for human review

NyxPixie uses AI to classify and summarize email. AI may misclassify or fail to surface important messages. The Service is a productivity aid, not a guaranteed safety net. You should not rely on NyxPixie as your sole means of monitoring email for time-critical, legally significant, or life-safety information. We are not liable for missed messages, missed deadlines, or any harm arising from AI classification errors.

4. Subscription and Payment

Some features of the Service require a paid subscription. Standard pricing is $39/month per Solo plan or as otherwise described on our pricing page. Beta and Founders accounts may be offered at no cost or at promotional pricing as separately disclosed.

Subscriptions auto-renew at the end of each billing period unless cancelled. You can cancel at any time via your account settings; cancellation takes effect at the end of the current billing period and you retain access through that date. We do not provide refunds for partial billing periods, except as required by applicable law.

Payment is processed by Stripe, Inc. By providing payment information, you authorize us (through Stripe) to charge the applicable fees, taxes, and currency-conversion charges to your payment method.

6. Intellectual Property

The Service, including software, design, content, branding (including the “NyxPixie” name and moon logo), and the My Pixie Suite trademarks, are owned by CNG Studios LLC and protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

Your data remains yours. You retain ownership of all email content, calendar data, and other information you make available to the Service. You grant us a limited license to access, process, and store this data solely to provide the Service to you, as described in our Privacy Policy.

7. Beta Disclaimer

NyxPixie is currently in beta. The Service may contain bugs, missing features, or unexpected behaviors. We may modify, suspend, or discontinue features without notice during this period. Beta access does not guarantee future availability or pricing.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THE ACCURACY OF AI-GENERATED CLASSIFICATIONS AND SUMMARIES. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CNG STUDIOS LLC, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you in full.

10. Indemnification

You agree to indemnify and hold harmless CNG Studios LLC, its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right.

11. Termination

You may terminate your account at any time by disconnecting Google access via myaccount.google.com/permissions and emailing support@mypixiesuite.com requesting account deletion.

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or extended inactivity. Sections 6, 8, 9, 10, and 13–15 survive termination.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated by email and a prominent notice on the Service at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

Informal resolution first: Before filing a claim, you agree to contact us at support@mypixiesuite.com and attempt to resolve the dispute informally for at least 60 days.

14. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision is not a waiver. These Terms constitute the entire agreement between you and CNG Studios LLC regarding the Service. You may not assign these Terms; we may assign freely in connection with a merger, acquisition, or sale of assets.
